General terms and conditions

1) General
The following general terms and conditions are valid for all contracts, deliveries and other services. I herewith strictly contradict differing regulations of the contract party. All collateral agreements require my written agreement. "Keramikwerkstatt Carola Müller” has the right to change and complete these general terms and regulations anytime with a reasonable notice. Incoming orders before will be handled with the then still valid old general terms and conditions.

2) Supply
My supplies are not binding. Small tolerances and changes to the images and descriptions are possible because each product is manufactured in handiwork and unique. The validity of a catalogue ends with the publication of a new catalogue.

3) Delivery and payment
An e-mail with a confirmation of your order and my bank account details is sent to you immediately. As a first-time customer you have to pay in advance. Please send the money along with your name and order number. On receiving the money I carry out your order. If you are already customer in "Keramikwerkstatt Carola Müller” you can send the money within 10 days on receiving your goods.

All prices include the legal VAT of 19% at the moment. I hold the right of partial delivery if this seems positive for a quick processing. Delivery is carried out by and according to the conditions of Hermes-Versand, plus packaging.

2. value of goods €11,00 – €55,00 = €5,95
3. value of goods €56,00 – €100,00 = €9,95
4. value of goods €101,00 – €250,00 = €15,00
5. value of goods €251,00 – €500,00 = €25,00

1. value of goods €0,00 – €55,00 = €15,00
2. value of goods €56,00 – €100,00 = €20,00

Switzerland and Liechtenstein:

1. value of goods €0,00 – €55,00 = €27,00

4) Delivery time
Goods on stock (we are not liable for transportation problems) will come to shipping within 10 working days. If the goods you order are not on stock, I will make an effort for fastest delivery. (You will be informed about it.)

If the non-compliance of delivery or service time is traced back to acts of God, labour dispute, unforeseeable obstacles or other circumstances I am not responsible for, the period will be adequately prolonged. Non-compliance of delivery time for other reasons hands the customer the right to set an adequate extension with the threat of cancellation; if the extension is not successful, the customer has the right to step back from the sales contract. Any claims for damages are excluded.

5) Right of return
For unused goods I guarantee a right of return of 14 days. The return period is granted by the in-time dispatch of the goods (date of invoice). The return is only accepted by us if it is sufficiently stamped.

The right of return is not valid for custom-made orders, reduced goods and special sales.

6) Warranty
“Keramikwerkstatt Carola Müller” guarantees the goods in flawless condition at the moment of dispatch. On receiving the customer has to examine the goods for defects and quality. Defects have to be reported to us within 10 days upon detection; otherwise warranty does not apply. In case of a complaint the sales date has to be proved by an invoice. The product has to be sent back sufficiently stamped along with an invoice copy. Warranty does not apply for natural wear and tear. Warranty expires if the customer changes the delivered goods.

During warranty obligation "Keramikwerkstatt Carola Müller” has the right of free fixing. A partial or complete exchange of the article is allowable. If defects are not fixed within a reasonable period of time, the customer has a claim to redhibitory or abatement. Valid is §476a BGB.

8) Reservation of title
Until receiving the complete payment, the goods remain property of "Keramikwerkstatt Carola Müller”.

10) Legal domicile
Place of fulfilment and legal domicile for both parties is the seat of "Keramikwerkstatt Carola Müller”. The laws of the Federal Republic of Germany are valid exclusively.
